Acceptable Use Policy

AHPRA and TGA content compliance requirements for your AestheticOS clinic portal.

1. Purpose

This Acceptable Use Policy ("AUP") sets out the rules and restrictions for content published through the AestheticOS platform ("Platform"). It supplements the Terms of Service and is designed to help Tenants meet their obligations under Australian health practitioner advertising regulations.

AestheticOS serves AHPRA-registered aesthetic practitioners. All content published through Tenant clinic portals must comply with AHPRA Advertising Guidelines, TGA regulations, Australian Consumer Law, and all other applicable legislation.

This AUP is not legal advice. If you are unsure whether specific content complies with your regulatory obligations, seek independent legal or regulatory advice.

2. Your Responsibility

As a Tenant, you are solely responsible for all content published on your clinic portal, including but not limited to treatment descriptions, product listings, blog posts, images, pricing, and staff profiles.

You must ensure that all content:

  • Complies with the AHPRA Guidelines for Advertising a Regulated Health Service (current version)
  • Complies with the Therapeutic Goods Act 1989 and TGA advertising requirements
  • Does not breach the Australian Consumer Law (Schedule 2, Competition and Consumer Act 2010)
  • Is accurate, not misleading, and within the scope of your AHPRA registration

We provide the tools; you are responsible for how you use them. We are not responsible for reviewing, approving, or auditing Tenant content for regulatory compliance.

3. AHPRA Advertising Compliance

Under the Health Practitioner Regulation National Law, advertising a regulated health service must not be false, misleading, or deceptive. The following content is prohibited on the Platform:

Testimonials:

  • You must not publish patient testimonials, reviews, endorsements, or recommendations about clinical aspects of a regulated health service
  • This includes text testimonials, video testimonials, star ratings related to clinical outcomes, and social media reviews about treatments
  • You may publish testimonials about non-clinical aspects such as customer service, clinic ambience, or general experience (not related to treatment outcomes)

Before-and-After Images:

  • Before-and-after photographs of patients are prohibited for advertising regulated health services under AHPRA guidelines
  • This applies regardless of whether the patient has given consent
  • You may use diagrams, illustrations, or stock imagery that do not depict actual patient results

Guaranteed Outcomes:

  • You must not claim or imply that a treatment will achieve a particular result
  • Words and phrases such as "guaranteed results", "100% effective", "permanent", "risk-free", or "no side effects" are not permitted
  • Results should be described as typical or possible, with appropriate qualifiers

Superiority Claims:

  • You must not claim that your services are superior to those of other practitioners without substantiation
  • Avoid phrases such as "best in Melbourne", "leading clinic", "number one provider", or similar superlatives unless they can be objectively verified

Creating Unreasonable Expectations:

  • Content must not create an unreasonable expectation of beneficial treatment outcomes
  • You should present balanced information including potential risks, side effects, and limitations of treatments

4. TGA Advertising Restrictions

Schedule 4 (S4) Medicines:

  • You must not advertise Schedule 4 (prescription-only) medicines to the public
  • The names of S4 medicines (including brand names and active ingredient names) must not appear on any public-facing page of your clinic portal
  • Pricing for S4 treatments must not be displayed publicly
  • You may refer to treatments using general, compliant descriptions (e.g., "anti-wrinkle injections", "dermal fillers", "skin boosters") rather than medication names

Compliant Naming:

The Platform encourages the use of TGA-compliant treatment names. Examples of acceptable and non-acceptable naming:

  • Acceptable: "Anti-wrinkle injections", "Dermal filler treatment", "Skin rejuvenation injection"
  • Not acceptable: Specific brand names of S4 medicines, active ingredient names of S4 medicines

If you are unsure whether a treatment name complies with TGA requirements, consult the TGA's advertising guidelines or seek professional advice.

5. Australian Consumer Law

All content on your clinic portal must comply with the Australian Consumer Law, including:

  • Pricing must be accurate and not misleading (including GST where applicable)
  • Treatment descriptions must be truthful and not omit material information
  • You must not engage in bait advertising (advertising services at a price you cannot supply in reasonable quantities)
  • Any promotional pricing must clearly state the terms and duration
  • Component pricing is prohibited — the total price must be displayed prominently

6. General Prohibited Content

In addition to the regulatory requirements above, the following content is prohibited on the Platform:

  • Content that is unlawful, defamatory, obscene, or infringes the intellectual property rights of any third party
  • Content that promotes services outside the scope of your AHPRA registration
  • Content that discriminates against any person based on race, gender, religion, sexual orientation, disability, or other protected characteristics
  • Malware, viruses, or any code designed to interfere with the Platform's operation
  • Spam, unsolicited bulk communications, or content designed primarily for search engine manipulation
  • Content that impersonates another person or entity
  • Embedded social media feeds, third-party widgets, or external scripts that load content from third-party platforms (e.g., Instagram feeds, Facebook plugins, Twitter embeds). These may introduce non-compliant content, tracking cookies, or performance issues beyond your control

7. AI Studio and Compliance

If your plan includes access to AI-powered content generation features (AI Studio), you must be aware of the following:

  • AI-generated content is provided as a draft only and must be reviewed by you before publication
  • AI may generate content that does not comply with AHPRA, TGA, or other regulatory requirements — it is your responsibility to identify and correct any non-compliant content
  • You must not use AI features to generate content about Schedule 4 medicines for public-facing pages
  • AI-generated content, once published, is treated as your content and you assume full responsibility for it
  • The AI features are not a substitute for professional regulatory or legal advice

We make reasonable efforts to train AI features to produce AHPRA-compliant content, but we do not guarantee compliance. The final responsibility always rests with you.

8. Platform Enforcement

We reserve the right to enforce this AUP to protect the integrity of the Platform and its users. Our enforcement process is as follows:

Detection:

  • We may become aware of potential AUP violations through automated monitoring, user reports, or manual review
  • We do not routinely audit all Tenant content, but we reserve the right to review content at any time

Notice:

  • If we identify content that may violate this AUP, we will notify the Tenant by email, identifying the specific content and the applicable rule
  • The Tenant will have a reasonable period (typically 7 days) to review and address the issue

Removal:

  • If the content is not corrected within the notice period, we may remove or disable the specific content
  • In cases of serious or clear-cut violations (e.g., publishing S4 medicine names publicly), we may remove content immediately without prior notice

Suspension:

  • Repeated or serious AUP violations may result in suspension or termination of the Tenant's account in accordance with the Terms of Service
  • We will provide written notice before any account suspension, except where immediate action is required to comply with law or prevent harm

9. Reporting Non-Compliant Content

If you become aware of content on the Platform that may violate this AUP, AHPRA guidelines, or TGA regulations, you can report it to us:

We will review all reports and take appropriate action. Reports can be made anonymously.

10. Changes

We may update this Acceptable Use Policy from time to time to reflect changes in regulations, Platform features, or our enforcement practices.

We will notify Tenants of material changes by email or prominent notice within the Platform at least 14 days before changes take effect.

Continued use of the Platform after the effective date of changes constitutes acceptance of the updated AUP.
